We’re thrilled to have successfully secured a change to the description of development for a client who is creating high-quality Houses in Multiple Occupation (HMO), classified as Sui Generis, in Middlesbrough.
In UK planning law, Sui Generis refers to a unique classification of land or property use that doesn’t fit within the standard use classes outlined in the Town and Country Planning (Use Classes) Order 1987 (as amended). Examples of Sui Generis uses include nightclubs, theatres, casinos, and HMOs with more than six residents.
This classification often requires careful consideration in planning applications to ensure compliance with regulations and address potential impacts on the local area, such as traffic, noise, or environmental concerns.
The Approval Process
The approval was achieved through a s96a Non-Material Amendment application, which allowed us to remove references to the number of HMO units and rooms from the description of development. This change was necessary to accommodate a revised layout that ensures compliance with Building Regulations. Importantly, this type of amendment modifies the description of development rather than resulting in a new planning permission or changes to planning conditions.
A separate s73 Minor Material Amendment application is also pending for the same site to address the layout changes in further detail. This application allows for adjustments to the planning conditions and is expected to receive a decision shortly, enabling our client to move forward confidently with their Sui Generis HMO development.
